House Bill to Test Where Members’ Allegiance Lies

The House Judiciary Committee is expected to complete work on the Pledge Protection Act, H.R. 2389, this week, paving the way for a vote in the full House. CMC strongly supports this bill, which would limit the jurisdiction of federal judges to make rulings concerning the Pledge of Allegiance.

The Pledge Protection Act, sponsored by Rep. Todd Akin, R-Mo., responds to a ruling the Ninth Circuit Court of Appeals made in 2003 declaring the phrase “under God” in the Pledge of Allegiance to be unconstitutional. An earlier version of the bill passed in the House in the previous session of Congress, but did not gain the necessary support to pass in the Senate. The U.S. Supreme Court overturned the Ninth Circuit in 2004 on technical grounds, but did not rule on the merits of the case.
